Tier 2 salary threshold requirement for ILR

The Tier 2  salary threshold requirement ILR is coming in to force. If you are ready to apply for settlement and have spent 5 years of continuous leave in the United Kingdom under Tier 2 Skilled Worker you will be required to demonstrate that you have held a salary equal or more than the salary your Certificate of Sponsorship was assigned for. However your salary must meet the new threshold requirement set out in the Immigration rules Part 6A: the points based system in order for your application for Indefinite Leave to Remain to be valid.

Currently the rules state that the threshold should be at least £35,000 per annum for applications made on or after 6th April 2016. Therefore applications made prior to 6th April 2016 will be considered under the old rules.

If you aren’t due to apply for another couple of years please bear in mind the salary threshold is expected to rise again from 6th April 2018 and annually thereafter up until 6th April 2020. Please refer to the below table.

Indefinite Leave to Remain salary requirement:

  1. 35000pa salary threshold requirement is from your one job only or one can do a graduate level job with 23000pa but manage to show 35000pa by some business or part time work. What’s gonna be procedure then??

    I am a Dr and my net income in 45000 but my basic is 30000. 15000 is my banding. According to new rules salary should more than 35000 for ILR means basic salary or net income?

  3. So just to be clear even though I’m not on a tier 2 visa but wish to apply for ILR we still need to earn 35k ? If so and we don’t earn that what is our options? Many thanks

  4. The salary for my job is 39,000 however I only work four days a week. The pro rata amount is under 35000. Is it the pro rata amount which is taken or the full time equivalent?

  5. Hello, I want to apply the ILR at Dec 2017. my current salary is under 35k, and I want to discuss with my boss about this.

    Is that ok that I get the 35k just before my application or shall I have the 35k salary for a period of time (such as a year) before I submit my ILR application?

  6. Hi I came in uk 2008 as student and I switch over tier 2 on aug 2011. my soc code 6244 and salary is 25000. So do i have to show 35 k salary or acording to soc code which is 23500 please advise me. Also when i contact ukba on jan they told me i have to pay whatever mention in my cos.
