Unmarried Partner Visa (UK) | Same-Sex Couples Applying from the United States

May 26, 2026

The UK Unmarried Partner visa allows U.S. nationals in a same-sex relationship with a British citizen or settled person to live together in the UK, without being married or in a civil partnership. Unlike spouse visas, this route relies on evidence of a genuine relationship, typically supported by at least two years of cohabitation or equivalent proof of a shared life.

Key Requirements

To be eligible, you must demonstrate:

  • A durable relationship akin to marriage or civil partnership
  • Evidence of living together, or a clear and evidenced reason why this has not been continuous
  • Intention to live together permanently in the UK

In addition, the UK partner must meet:

  • the minimum income requirement, and
  • provide suitable accommodation.

Where Applications Go Wrong

Common issues include:

  • gaps in cohabitation evidence
  • informal living arrangements without documentation
  • inconsistent timelines across documents
  • strong relationships that are not clearly presented against the rules

The Home Office does not interpret or fill gaps – the relationship must be demonstrated clearly and consistently.

Our Approach

We do not approach these cases as a document‑gathering exercise.

We:

  • assess whether the relationship meets the legal standard,
  • identify evidential gaps early,
  • structure the application so the relationship is clear and chronological,
  • ensure financial requirements are met properly.

Where cohabitation is not straightforward, we focus on building a coherent and defensible evidential framework.

When to Be Careful

Applications require particular care where:

  • the relationship has been long‑distance,
  • cohabitation is limited or irregular,
  • documentation is incomplete, or
  • there has been previous immigration history.

In these cases, timing and preparation are critical.
