Proving your right to work is for many one of the most important parts of having a UK work visa. The Right to Work Check is for anyone who is under immigration control to prove that their visa permits them to work in the UK. The request by employers to those who are under immigration control can be very stressful as by not being able to prove your right to work you may lose your job. How to go about proving this depends on how you entered the UK in the first place.
Right to work check through the ID Check app
If you have settled or pre-settled status under the European Settlement Scheme or when you applied for your visa and used the ‘UK Immigration: ID Check’ app to scan your identity document on your phone then you will have an online ‘UK Visas and Immigration account’. Accessing this account must be done using the identification document that you used to get your visa, most likely to be your passport. Once into the account you can then generate a numerical code which you then share with your employer who will then be able to determine your ‘right to work’. Importantly for many, should you need to update your passport or contact details you can also do this using your account but if it is the first time you are updating then access needs to be made using the I.D. document used to make your application to enter the U.K.
If, however you have a vignette (sticker) in your passport and a subsequent biometric residence permit then you must use the card number and your date of birth, so that you may generate a code to share with your employer. Once they have this code and through your sharing it your permission, they can access your right to work via the online system provided for this purpose.
The same process can be used for those who wish to prove their right to rent to a prospective landlord. If someone’s documents are currently with The Home Office, then landlords can make their own check via the Home Office. Otherwise, if an in-time application has been made to the Home Office then the applicant’s right to reside and work continue automatically until such time as a decision has been made.
